STANDARD TERMS OF SALE AND DELIVERY
1. Delivery: Drivers will make every effort to
place material where customer/agent designates. Adequate jobsite
access and proper onsite delivery instructions shall be provided
by the customer/agent to make ingress and egress possible for safe
delivery and unloading. Damages inside the project property boundary
to sidewalks, driveways, buildings, shrubbery, trees, low overhead
or underground lines, etc., is the customers sole responsibility.
Customer is responsible for providing a suitable wash down area
for mixers at or near the place of delivery where washout drainage
is contained. Customer will be charged a $80.00 fee
if a suitable washout area is not provided. The clean-up resulting
from debris or mud tracked onto public or private roadways from
mixer tires is the complete responsibility of the purchaser.
Concrete is a perishable product. Customer is responsible for late
cancellations of batched concrete. All concrete properly dispatched
and loaded, with delivery on the way, will be charged to customer
for each cubic yard ordered.
2. Delivery area: Base concrete prices are good
in South Salt Lake County(7200 South), Utah County, Juab County,
Sanpete County, and Sevier County valley locations. Concrete delivery
to outlying areas, i.e., mountains, canyons, and desert locations
is available with a mileage charge. Call for a quotation.
3. Scheduling: All orders must be place with the
dispatcher. Utah County (801)785-5600 ext. 2, Salt Lake
County (801)364-1616 ext 2, Juab County (435)623-2202 ext 2, Sanpete
County (435)462-2058, Sevier County (435)529-7496. Advance
notice of accurate orders ensures quality service and timely delivery
for our customers. Maintenance of planned schedules depends upon
release of trucks from earlier jobs. We do not accept claims or
backcharges for pump/crane time or workman’s wages for delays
we may experience with our equipment that affects customers scheduled
production.
4. Cement: Cement used in the production of concrete
is manufactured by others. The color of the cement and the color
of the concrete is not guaranteed.
5. Mix Designs: Standard mix designs are sold
by the bag. A bag is defined as an engineered bag containing a partial
flyash replacement and will be delivered unless otherwise specified.
“Full bag or Straight bag” Portland cement mixes are
furnished upon request at the added rate of $4.00 per yard. All
concrete shall be delivered air-entrained in accordance with standard
ACI requirements for our Utah delivery area. Low air or no air-entrained
mixes can be furnished upon request. Concrete mix designs including
specialty mix designs, in accordance with customer’s specifications
can be furnished by Westroc.
6. Yield: “In place” or “in
the form” yield will not be guaranteed. Westroc custom concrete
mix designs are calculated by the absolute volume method. All batch
scales are certified by the State of Utah. Proper mix proportioning
and yield is guaranteed measured in a calibrated, weight certified
hopper at the point of discharge or by ASTM C 138 Standard Specification
method of determination. The apparent volume of hardened concrete
could appear less than expected due to jobsite conditions including
waste, spillage, overexcavation, spreading forms, some loss of entrained
air content or settlement of wet mixtures, none of which is the
responsibility of Westroc. The National Ready Mixed Concrete Association
recommends estimating extra concrete of 4 to 10 percent over plan
dimension for waste, overexcavation and other causes.
7. Guarantee: Westroc warrants that all concrete
is produced in accordance with the American Concrete Institute requirements
for structural concrete and that all materials used in the production
of concrete are produced and delivered in conformance to the applicable
ASTM Standard Specifications. Proper proportioning, air content,
and compressive strength is guaranteed in accordance with correct
construction procedures and conformance to the applicable standard
specifications. Due to important factors which are beyond the control
of the producer, including proper handling and placement, consolidation,
finishing, weather conditions, curing and protection, finished results
are not guaranteed.
8. Collection: Approved C.O.D. orders are due
upon or prior to delivery. A prompt payment discount in
the amount of 2% is available for established 30 day charge
accounts and will be allowed on all purchases when payment is received
in our office by the 20th day of the month following the month of
purchase. If there is a past due balance on the account beyond the
30th day of the month following the month of purchase, a prompt
payment discount will not be allowed on any other subsequent purchases.
This discount policy is firm. A finance charge in the amount of
1 ½% per month will be charged on unpaid balances of 60 days
beyond the last day of the month of purchase. Customer agrees to
pay all collection costs and attorney fees in collection of delinquent
accounts All concrete price quotations are valid subject to credit
approval. Concrete price quotations are subject to price increases
without advanced notice.
